OVERVIEW
The terms “we”, “us” and “our” refer to FUSS. FUSS operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). FUSS is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy.

SECTION: ACCESS AND ACCOUNT
By agreeing to these Terms, you confirm that you are at least 18 years old (or the age of majority in your country). You may be asked to provide certain information, such as your email, billing, payment, and shipping details. You represent that this information is correct and up to date.

SECTION: OUR PRODUCTS
We try to represent our products as accurately as possible. However, colors and appearance may differ depending on your device and settings.
Product descriptions may change at any time. We may discontinue products or limit availability by region or customer.

SECTION: RETURNS & RIGHT OF WITHDRAWAL (EU CONSUMER RIGHTS)

If you are a consumer in the EU, you have the legal right to withdraw from your purchase within 14 days after receiving the goods, without giving any reason.

To exercise this right, submit a return request through our Customer Care page by completing the return form. After registering your return, you must send the products back within 14 days.

The costs of returning the products are for your account. A standard return fee of €3.95 will be deducted from your refund.

If you wish to exchange an item, the return of the original item is free of charge. A one-time shipping fee of €3.95 will apply for sending the replacement item.

We will refund the purchase price (minus return costs) within 14 days after we receive the goods, using the same payment method you used, unless otherwise agreed. We may withhold the refund until we have received the goods or proof of return.

SECTION: PAYMENT METHODS AND VAT
We accept iDEAL, credit card, Shopify Pay, Google Pay, Apple Pay, and any other methods indicated at checkout.
FUSS uses the Dutch small business scheme (KOR – Kleineondernemersregeling). This means no VAT is charged on our sales. All prices in our store are VAT-exempt. Any applicable shipping costs will be shown during checkout.

SECTION: WARRANTY (FUSS)
At FUSS, we stand behind the quality of our products. Each piece is crafted with care to meet our standards.
All products are covered by a six (6) month service warranty, in addition to your statutory rights. Within this period, our Customer Care team will review your claim and discuss a suitable solution — such as repair, replacement, or refund — provided the conditions below are met.

Warranty applies if:

  • The item has been used under normal conditions.

  • Washing and care instructions were followed.

  • The issue was reported directly after it occurred.

  • Proof of purchase is available.

Exclusions: damage from ignoring care instructions, exposure to chemicals, fire, UV, bleach, extreme use (e.g. sports), sharp or abrasive surfaces, neglect, poor storage, unauthorised repairs, abnormal impacts, or natural ageing of materials.

SECTION: ORDERS
Placing an order is an offer to purchase. Orders are only accepted once confirmed by FUSS and payment is processed. Review your order carefully before submitting. Cancellations may not be possible after acceptance.
If we cannot accept or need to change your order, we will notify you.
Returns and exchanges are handled according to our Refund Policy.

SECTION: DELIVERY
We will deliver your order within 3-5 business days unless otherwise agreed. If delayed, we will notify you.
Risk of loss or damage passes to you only once you have physically received the goods.
Delivery times are estimates; we are not responsible for delays by carriers, customs, or events outside our control.

SECTION: PRICES AND BILLING
Prices are shown in EUR and are VAT-exempt under the Dutch small business scheme (KOR). Shipping costs and, where applicable, customs/import charges will be shown at checkout.
Discounts and promotions may change without notice. The price charged is the price at checkout.

SECTION: INTELLECTUAL PROPERTY
All trademarks, names, designs, logos, images, text, and other content on the Services are owned by FUSS or its licensors and protected under Dutch and international law.
You may not copy, reproduce, or use this content without our prior written consent.
FUSS is a registered trademark at the Benelux Office for Intellectual Property (BOIP).
Shopify’s names, logos, and marks are trademarks of Shopify. Other third-party names and marks remain the property of their respective owners.

SECTION: THIRD-PARTY LINKS & TOOLS
Our Services may include links or tools from third parties. We are not responsible for their content, accuracy, or practices. Use of such sites or tools is at your own risk and subject to their terms.

SECTION: RELATIONSHIP WITH SHOPIFY
FUSS is powered by Shopify. However, your purchase contract is with FUSS only. Shopify is not a party to your purchase.

SECTION: PRIVACY POLICY
FUSS is the data controller for personal data processed via our Services and processes personal data in line with the EU GDPR.
Our Privacy Policy explains how we handle your data and your rights. 

SECTION: FEEDBACK
By submitting reviews or feedback, you grant us a non-exclusive right to use them for store operations and promotion.

SECTION: ERRORS & INACCURACIES
We may correct errors or update information (including after an order). If this affects your order, we will notify you.

SECTION: PROHIBITED USES
You may only use the Services lawfully. Prohibited uses include: unlawful activity, infringement of intellectual property, misrepresentation, spreading malware, or attempting to bypass security.

SECTION: TERMINATION
We may suspend or terminate your access to the Services if you violate these Terms. Obligations that should survive termination (e.g. intellectual property, warranty, governing law) will remain in effect.

SECTION: DISCLAIMER OF WARRANTIES
Except as required by law, the Services and products are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation.
Nothing in these Terms affects your statutory consumer rights.

SECTION: LIMITATION OF LIABILITY
To the fullest extent allowed by law, FUSS is not liable for indirect, incidental, or consequential damages.
Nothing in these Terms excludes or limits your rights under mandatory consumer law.

SECTION: GOVERNING LAW
These Terms are governed by Dutch law. Disputes will be handled by the competent courts in the Netherlands, without prejudice to your rights under consumer protection laws to bring proceedings in your country of residence.

SECTION: CHANGES TO TERMS
We may update these Terms from time to time. Material changes will be communicated, and updated Terms will apply from the date specified. Continued use of our Services constitutes acceptance.
